PUBLIC OFFER OF THE ONLINE STORE "GIZHIK"


Key Concepts
1.1. Online Store — the website located at https://gizhik.com, through which the Seller sells Products remotely.
1.2. Product — a tangible item placed in the Online Store and available for ordering by the Buyer.
1.3. Order — a properly completed and submitted request by the Buyer via the shopping cart for the purchase and delivery to the address specified by the Buyer or for in-store pickup of Products selected on the Website.
1.4. Buyer — the Buyer — any individual who has accepted this Agreement.
1.5. Website — https://gizhik.com
1.6. Seller — Ekaterina Anatolyevna Gizhevskaya, Individual Entrepreneur, Taxpayer Identification Number (INN) 667016433832, registered office: 620137, Russia, Sverdlovsk Region, Yekaterinburg, ul. Blukhera, 41, office 137, accepting orders through the Website for the purpose of selling products.
1.7. Acceptance — the Buyer's placing an order for the Product in accordance with the terms of the Public Offer.

General Provisions
2.1. The Seller undertakes to transfer ownership of the Products ordered on the Online Store website to the Buyer, and the Buyer undertakes to pay for and accept them.
2.2. If the Buyer disagrees with any of the provisions of this Agreement, the Buyer may not order or submit requests for the Products through the website or by phone at https://gizhik.com.
2.3. These Terms of Sale, as well as the information about the Products provided on the Website, constitute a public offer in accordance with Article 435 and paragraph 2 of Article 437 of the Civil Code of the Russian Federation. Consumer protection relations are regulated by the Civil Code of the Russian Federation, the Law "On the Protection of Consumer Rights," the Decree of the Government of the Russian Federation "On Approval of the Rules for the Remote Sale of Products," and other federal laws and legal acts of the Russian Federation adopted in accordance therewith.
2.4. The Public Offer may be amended by the Seller unilaterally without notice to the Buyer. The new version of the Public Offer shall take effect upon its publication on the Website and shall apply to any Order placed after its publication, unless otherwise provided by the terms of this Public Offer.
2.5.1. The Public Offer shall be deemed accepted by the Buyer from the moment the Buyer places an Order without authorization on the Website, as well as from the moment the Buyer's Order is accepted through the "Place an Order" page in the Cart section of the Website.
2.5.2. The Agreement concluded based on the Buyer's acceptance of this Offer is an adhesion agreement, to which the Buyer accedes without any exceptions and/or reservations.
2.5.3. The fact of placing an Order by the Buyer constitutes the Buyer's unconditional acceptance of the terms of this Agreement. The Buyer, having placed an order in the Seller's online store, is deemed to have entered into a relationship with the Seller under the terms of this Agreement.
2.6. The retail sale and purchase agreement is deemed concluded upon the Seller's issuance to the Buyer of a cash register receipt, sales receipt, or other document confirming payment for the goods.
2.7. By providing the Seller with their email address and telephone number, the Buyer consents to the use of such means of communication by the Seller, as well as third parties engaged by the Seller for the purpose of fulfilling their obligations to Buyers, for the purpose of sending advertising and informational mailings containing information about discounts, upcoming and current promotions, and other Seller events, about the order's delivery, as well as other information directly related to the fulfillment of the Buyer's obligations under this Public Offer.
2.8. By placing an Order, the Buyer agrees that the Seller may entrust the execution of the Agreement to a third party, while remaining responsible for its performance.
2.9. The Buyer can place an order in the online store at https://gizhik.com 24 hours a day, 7 days a week, except during periods of maintenance or technical failures.
2.10. Delivery and return/exchange terms are available on the website https://gizhik.com in the "Delivery" and "Exchange and Return" sections.
2.11. All text information and graphic images of products posted on the Website are the property of the Seller or its counterparties. Viewing information or printing pages from the Website is permitted for personal use only.

Subject
3.1. The subject of this Public Offer is the opportunity for the Buyer to purchase Products presented in the Online Store catalog at https://gizhik.com for personal, family, household, and other non-business purposes by purchasing the Products.
3.2. This Public Offer applies to all types of Products presented on the Website, as long as such offers and descriptions remain available in the Online Store catalog.

Products and Purchase Procedure
4.1. Registration on the Website is not required to place an Order.
4.2. The Seller is not responsible for the accuracy and correctness of the information provided by the User when ordering a Product.
4.3. If the Products ordered by the Buyer are not available in the Seller's warehouse, the Seller reserves the right to offer an exchange for other items from the store's inventory, or exclude the specified Product from the Order/cancel the Buyer's Order by notifying the Buyer by sending an appropriate email to the address provided by the Buyer during registration. The photographs accompanying the Product are merely illustrations and may differ from the actual Product. The descriptions/specifications accompanying the Product are not intended to be exhaustive and may contain typos. For more information regarding the Product, the Buyer should contact the Seller through the feedback system specified in the "Contacts" section.
4.4. In the event of cancellation of a fully prepaid Order, the Seller will refund the cost of the cancelled Product to the Buyer using the method by which the Product was originally paid.
4.5. The Buyer's Order is processed in accordance with the procedures specified in the "Cart" section of the Website.
4.6. The Buyer is fully responsible for any incorrect information provided, which results in the Seller's inability to properly fulfill its obligations to the Buyer.
4.7. After placing an Order on the Website, the Buyer will be provided with information about the estimated delivery time by sending a message to the email address or phone number specified by the Buyer during registration.
4.8. The Seller may unilaterally change the Product delivery date if there are objective reasons, in the Seller's sole discretion.

Order Delivery
5.1. Delivery methods for Products sold by the Seller are specified in the "Delivery" section of the Website. Specific delivery times may be agreed upon by the Buyer when confirming the order.
5.2. Delivery is carried out by courier to all cities in Russia and/or internationally by transport company and/or postal service. The delivery territory for Products listed on the Website and sold by the Seller is unlimited (worldwide) and/or, in exceptional cases, is determined depending on the type of Product. In exceptional cases, the delivery territory and/or methods are specified in the Product checkout section and/or verified with the Seller.
5.2.1. Delivery of Products to certain countries may be restricted by the laws of the delivery country and/or regulations of individual countries and/or international relations. In the event of delivery restrictions, the product must be returned to the seller by any available means. The money paid for the product will be refunded within 10 days using the method by which it was originally paid.
5.2.2. For Customers from non-CIS countries, the Seller ships orders excluding taxes and duties applicable to the Buyer's country of residence. The shipping price does not include taxes and duties.
5.3. The Seller strives to adhere to the agreed delivery times as much as possible. The Seller is not responsible for any delays in delivery due to unforeseen circumstances beyond the Seller's control.
5.4. Upon delivery, the Order will be delivered to the Buyer or a third party specified in the Order as the recipient (hereinafter, the Buyer and such third party are referred to as the "Recipient"). If the aforementioned persons are unable to receive the Order, the Order may be delivered to a person who can provide information about the Order (shipment number and/or Recipient's full name).
5.5. The risk of accidental loss of or damage to the Goods passes to the Buyer upon delivery of the Order and the Recipient's signature on the documents confirming delivery of the Order. In the event of non-delivery of an Order, the Seller will reimburse the Buyer for the full cost of the Order and shipping upon receipt of confirmation of the Order's loss.
5.6. The shipping cost for each Order is calculated individually and depends on the selected delivery method.
5.7. The Buyer understands and agrees that shipping is a separate service and is not an integral part of the Product purchased by the Buyer. Claims regarding the quality of the purchased Product that arise after receipt and payment for the Product are considered in accordance with the Law of the Russian Federation "On Protection of Consumer Rights." Therefore, purchasing a Product with delivery does not entitle the Buyer to a refund for the shipping cost in cases where the Buyer is entitled to a refund for the Product itself, in accordance with the Law of the Russian Federation No. 2300-1 "On Protection of Consumer Rights" dated February 7, 1992.
5.8. The Seller's obligation to deliver the goods to the Buyer is deemed fulfilled upon delivery of the goods to the Recipient or upon receipt of the goods by the Recipient at a post office or at a pre-agreed Order pickup location (including a pickup location).
5.9. In the event of a return of goods delivered via a transport company or postal service due to a complaint regarding the goods, the Recipient is obligated to include the following documents with the shipment containing the returned goods: a return form, a photograph documenting the defect, and an expert assessment report (if one has been conducted).

Payment for Products
6.1. The price of products sold in the Online Store is indicated in dollars. Payment is made to the accounts specified by the Seller.
6.2. Product prices are determined by the Seller unilaterally and without dispute and are displayed on the Online Store pages. If the price of a Product ordered by the Buyer is incorrect, the Seller will notify the Buyer so that the Order can be confirmed at the corrected price or the Order can be cancelled. If the Buyer cannot be contacted, the Order is considered cancelled, unless the price for the Product has been reduced and/or is lower than the price displayed on the Online Store pages. If the Order has been paid, the Seller will refund the amount paid to the Buyer using the same method used to pay.
6.3. The price of a Product on the Website may be changed unilaterally by the Seller. However, the price of the Product ordered by the Buyer is not subject to change. The offer to enter into a contract for a specific product is valid for the period the product is listed on the Seller's website, provided the product is available in the Seller's warehouse.
6.4 The Buyer pays for the Product using the methods specified in the "Cart" section of the Online Store.
6.5. Payment by Bank Card:
6.5.1. In accordance with Bank of Russia Regulation No. 266-P "On the Issuance of Bank Cards and on Transactions Conducted Using Payment Cards" dated December 24, 2004, bank card transactions are carried out by the cardholder or their authorized representative.
6.6. Authorization of bank card transactions is performed by the bank. If the bank has reason to believe that the transaction is fraudulent, it reserves the right to refuse to process the transaction. Fraudulent transactions with bank cards are covered by Article 159 of the Criminal Code of the Russian Federation.
6.7. To prevent any misuse of bank cards during payment, all Orders placed on the Website and prepaid by bank card are verified by the Seller.
6.8. The Seller reserves the right to offer discounts on Products and establish a bonus program. The types of discounts, bonuses, and the accrual procedures are determined by the Seller independently and are specified on the Website.
6.9. When conducting marketing activities that involve including items in the Buyer's Order, delivery of such items is at the Buyer's expense. To refuse the inclusion of an item, the Buyer must contact the Seller through the "Contacts" section.

Returns and Exchanges of Products and Funds
7.1.1. Products sold by the Seller may be returned in accordance with the following return conditions:
7.1.2. Products that do not suit the Buyer due to shape, size, style, color, size, or configuration may be exchanged within the exchange period of 7 days from the moment the parcel arrives at the pickup point/delivery by the courier.
7.1.3. Products may be returned or exchanged if: their presentation (packaging, seals, and tags) is intact, their consumer properties are intact, and a document confirming the fact and conditions of purchase (sales receipt or cash register receipt) is present. Returns/exchanges must be made in the original packaging with any gifts and other inserts, the branded box, or a textile bag. Goods of proper quality cannot be returned if the hanging plastic seal with the company logo is damaged. Article 478 of the Civil Code of the Russian Federation.
7.2. Return of Goods of Proper Quality
7.2.1. The Buyer has the right to refuse the ordered Goods at any time before receiving them, and after receiving the Goods within 7 (seven) days at a retail store, and 7 (seven) days (online store), from the moment the parcel arrives at the pickup point/delivery by the courier. The following categories of goods are not subject to return: made-to-order (custom-made), not from stock, as well as the category of lingerie sets, corsets, and mesh products, which fall under the category of underwear, included in the "List of non-food products of proper quality that cannot be returned or exchanged for a similar product of a different size, shape, style, or color." Goods of proper quality may be returned if their presentation and consumer properties are preserved.
7.2.2. If the Buyer refuses the Goods, the Seller will refund the cost of the returned Goods, less the Seller's expenses associated with the delivery of the returned Goods by the Buyer, within 10 (ten working days) days from the date of receipt of the returned Goods at the Seller's warehouse along with a refund application completed by the Buyer.
7.2.3. If at the time of the Buyer's request, a similar product is not available for sale from the Seller, the Buyer has the right to refuse to fulfill this Public Offer and demand a refund of the amount paid for the specified Goods. The Seller is obligated to refund the amount paid for the returned item within 10 (ten) days from the date of return of the item.
7.2.4. To return a product of proper quality (including for exchange), the Customer undertakes to carefully package the item (with all components and a full set of accessories specified in the technical documentation for the item) and attach the following documents: a return form, a copy of a passport (or other identification document), a copy of the sales receipt.
7.3. Return of a product of inadequate quality:
7.3.1. A product of inadequate quality is one that is defective and cannot fulfill its functional properties, or does not meet the requirements specified in the creative assignment (for custom-made products). The received product must match the description on the Website. Any design or presentation elements that differ from the description on the Website does not constitute a sign of inadequate quality.
7.3.2. Appearance and completeness of the product, as well as its completeness The entire Order must be checked by the Recipient at the time of delivery of the Product.
7.3.3. If the Buyer received a Product of inadequate quality, and the Seller has not agreed otherwise in advance, the Buyer has the right to avail themselves of the provisions of Article 18 "Consumer Rights Upon Discovery of Defects in the Product" of the Law of the Russian Federation of 07.02.1992 N 2300-1 "On the Protection of Consumer Rights."
7.3.4. Claims for a refund of the amount paid for the Product must be satisfied within 10 (ten) business days from the date of submission of the corresponding claim (Article 22 of the Law of the Russian Federation "On the Protection of Consumer Rights").
7.3.5. Refunds will be made after receipt of your order, by refunding the cost of the Product paid for to the bank card specified when ordering the Product. Refunds will be made after receipt of your order, to your bank account within 10 business days.
7.4. Return Methods:
7.4.1. Through a retail Store
7.4.3. By transport company or postal service, at the Buyer's discretion. The Buyer sends the returned item by registered mail, without cash on delivery. Parcels sent cash on delivery will not be accepted for return. A completed return form must be included with the parcel.
7.5. The Buyer bears the cost of returning the item, whether of good or bad quality.

Liability
8.1. The Seller is not liable for any damage caused to the Buyer due to improper use of Products purchased from the Online Store.
8.2. The Seller is not liable for the accuracy of the information provided by the User during registration or placing an Order.

Personal Data Protection
9.1. The Buyer's personal data is processed in accordance with Federal Law No. 152-FZ "On Personal Data."
9.2. When placing an order on the Website, the Buyer provides the following information: last name, first name, contact phone number, email address, and delivery address with city postal code.
9.3. By providing their personal data, the Buyer consents to its processing by the Seller, including for the purposes of fulfilling the Seller's obligations to the Buyer under this Public Offer, promoting the Seller's goods and services, conducting electronic and SMS surveys, monitoring the results of marketing campaigns, providing customer support, organizing product delivery to Buyers, conducting prize draws among Buyers, monitoring Buyer satisfaction, and assessing the quality of services provided by the Seller.
9.4. Personal data processing means any action (operation) or set of actions (operations) performed with or without the use of automated tools with personal data, including the collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (including transfer to third parties, not excluding cross-border transfer, if necessary in the course of fulfilling obligations), anonymization, blocking, deletion, and destruction of personal data.
9.5. The Seller has the right to send informational messages, including advertising messages, to the Buyer's email address and mobile phone with their consent, expressed by their actions that uniquely identify the subscriber and allow their intent to receive the message to be reliably established. The Buyer has the right to refuse to receive advertising and other information without explaining the reasons for the refusal by informing the Seller of their refusal by telephone or by sending a corresponding request to the Seller's email address.
9.6. The Seller has the right to use cookies. Cookies do not contain confidential information. The Buyer hereby consents to the collection, analysis, and use of cookies, including by third parties, for the purposes of generating statistics and optimizing advertising messages.
9.7. The Seller receives the Website Visitor's IP address. This information is not used to identify the Website Visitor.
9.8. The Seller is not responsible for information provided by the Buyer on the Website in a publicly accessible form.
9.9. The Seller has the right to record telephone conversations with the Buyer. In doing so, the Seller undertakes to: prevent unauthorized access to information obtained during telephone conversations and/or its transfer to third parties not directly involved in the fulfillment of Orders, in accordance with Clause 4 of Article 16 of the Federal Law "On Information, Information Technology, and the Protection of Information."
9.10. The Buyer consents and authorizes the Operator and the Operator's counterparties to process the Buyer's personal data using automated database management systems and other software specifically developed on the Operator's behalf.
9.11. The Buyer has the right to request from the Operator full information about their personal data, its processing and use, and to request the deletion, correction, or addition of incorrect or incomplete personal data.
9.12. The Client may unsubscribe from receiving newsletters, advertising, and other information without explanation in one of the following ways: the Client may select mailing preferences or unsubscribe by clicking the "Unsubscribe" button in the email; or the Client may contact the Seller's Customer Service team at the phone number listed on the website at https://gizhik.com in the "Contacts" section.
9.13. The Seller undertakes not to disclose the information received from the Client. It is not considered a violation for the Seller to provide information to agents and third parties acting on the basis of an agreement with the Seller to fulfill obligations to the client.

Validity of the Public Offer
10.1. This Public Offer shall enter into force upon its acceptance by the Buyer and shall remain in effect until the acceptance of the Public Offer is revoked.

Additional Terms
11.1. The Seller reserves the right to assign or otherwise transfer its rights and obligations arising from its relationship with the Buyer to third parties.
11.2. The online store and the services provided may be temporarily, partially, or completely unavailable due to maintenance or other repairs, or for any other technical reasons.
11.3. The provisions of Russian law apply to the relationship between the Buyer and the Seller.
